The impact of Covid-19 on the right to a fair trial

Research background

Halting jury trials due to Covid-19 has led to a huge backlog of criminal cases.  Although there is talk of jury trials re-starting, albeit on a much smaller scale, the impact of this on the right to a fair trial is not known.

Research aims

The research aims to understand whether Covid-19 has had an impact on the right to a fair trial, and to explore strategies that will maintain public safety but ensure a fair trial.

Research methods

The project will consist of a series of interviews with criminal justice professionals to explore their views.

Projected outcomes

It is hoped that the research might help inform policy and practice developments, with regards to ensuring trial processes adhere to appropriate standards whilst taking place in accordance with constraints and constrictions in place because of Covid-19 (via whatever mechanisms).
